The law and justice machinery of a country serves to be an important resource for, an adjunct to, development or directed transformations, as Baxi underlines in ‘People’s Law, Development and Justice’ (1979). This machinery sets out a framework that enables the citizens to use their agency in exercising their rights and equitable participation. However, in the current, evolving and rapidly changing contexts, the old and set ways laid by doctrines and constitutions fall short of achieving the deliberated effects of equity and protection of human rights, especially the rights of the vulnerable and marginalized communities.
